These Terms of Use govern your access to and use of the Built Simple platform, including the website (builtsimple.com.au), the web application (app.builtsimple.com.au), and our mobile applications (collectively, the “Platform”). By accessing or using the Platform, you agree to be bound by these Terms.

Built Simple Solutions Pty Ltd (ABN 42 683 640 360) operates the Platform from 3/21 Simms Rd, Greensborough VIC 3088, Australia.

1. Acceptance and eligibility

You must be at least 18 years old and have legal authority to enter into a binding contract. By creating an account you confirm you meet these requirements. If you accept these Terms on behalf of a business, you confirm you have authority to bind that business.

2. Account registration

To use the Platform beyond the free calculators, you must create an account. You agree to:

  • Provide accurate and complete registration information.
  • Maintain the security of your account credentials.
  • Notify us immediately of any unauthorised use of your account.
  • Accept responsibility for all activity that occurs under your account.

3. Subscription plans, billing and auto-renewal

Built Simple offers Freemium, Tradie, Builder and Pro plans. Pricing is in Australian dollars and includes GST.

Auto-renewal disclosure: paid plans renew automatically at the end of each billing cycle (monthly or annual) at the then-current price. We will email you a reminder before annual renewals. You can cancel auto-renewal at any time from your account settings; cancellation takes effect at the end of the current billing period.

Free trials automatically convert to a paid plan at the end of the trial unless cancelled before the trial ends.

4. Refunds and cancellations

You may cancel your subscription at any time. Cancellation stops future billing; we do not provide pro-rata refunds for partial billing periods unless required by law.

Nothing in this section limits any rights you have under the Australian Consumer Law (see Section 12).

5. Acceptable use

You agree not to:

  • Use the Platform for any unlawful purpose or in breach of any applicable law.
  • Reverse engineer, decompile, or attempt to extract the source code of the Platform.
  • Resell, sublicense, or share access to your account.
  • Upload content that is unlawful, defamatory, or infringes intellectual property of others.
  • Attempt to disrupt, interfere with, or gain unauthorised access to the Platform or other accounts.
  • Use the Platform to send spam, malware, or to harass any person.

6. Your content and data

You retain ownership of all project data, files, photos and information you upload (“Your Content”). You grant Built Simple a limited, worldwide, royalty-free licence to host, process and display Your Content solely for the purpose of providing the Platform to you. We do not sell or share Your Content with third parties for marketing.

You are responsible for maintaining your own backups of Your Content. Built Simple is not a backup service.

7. Privacy

Our handling of personal information is governed by our Privacy Policy, which forms part of these Terms.

8. Intellectual property

The Platform, including all software, design, branding, content (excluding Your Content), and the Built Simple name and logo, is owned by Built Simple Solutions Pty Ltd and protected by Australian and international intellectual property laws. You receive a limited, non-transferable, revocable licence to use the Platform during an active subscription. You do not acquire any ownership rights.

9. Free calculators

The 47 construction calculators on builtsimple.com.au/calculator/ are provided free of charge as a public resource. Results are estimates only and should not replace advice from a qualified professional. Built Simple makes no warranty as to the accuracy of calculator outputs and is not liable for decisions made on the basis of calculator results.

10. Service availability

We aim to keep the Platform running continuously but do not guarantee uninterrupted service. We may take the Platform offline for maintenance, upgrades, or in response to a security event. Where practical, we will provide reasonable advance notice.

11. Limitation of liability

To the maximum extent permitted by law, Built Simple’s total liability to you for any claim arising from your use of the Platform is limited to the amount you paid us in the 12 months prior to the claim. We are not liable for indirect, consequential, or special damages, including loss of profits, loss of data, or business interruption.

12. Australian Consumer Law

Our goods and services come with consumer guarantees under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) which cannot be excluded.

You are entitled to a replacement or refund for a major failure and to compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods or services repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.

Nothing in these Terms limits, restricts, modifies or excludes any guarantee, right or remedy that you have under the Australian Consumer Law where that guarantee, right or remedy cannot be limited or excluded.

13. Unfair contract terms

If any term of these Terms is found to be unfair under the unfair contract terms regime in the Australian Consumer Law, that term will be void to the extent of the unfairness, but the remainder of these Terms will continue to apply.

14. Termination

You may terminate your account at any time. We may suspend or terminate your access if you breach these Terms, fail to pay, or use the Platform in a way that risks harm to other users, our business, or third parties. On termination, your right to access the Platform ends. We retain Your Content for 90 days after cancellation (recoverable on request) and then permanently delete it.

15. Changes to these Terms

We may update these Terms from time to time. Material changes will be communicated by email or via the Platform at least 14 days before they take effect. Continued use after changes take effect constitutes acceptance.

16. Governing law and jurisdiction

These Terms are governed by the laws of Victoria, Australia. The parties submit to the exclusive jurisdiction of the courts of Victoria, except where the Australian Consumer Law provides otherwise.

17. Disputes

If a dispute arises, please contact us first at [email protected] so we can attempt to resolve it directly. If you remain dissatisfied, you may contact the Australian Competition and Consumer Commission (ACCC) at accc.gov.au or your state consumer affairs office.
